1. Program Description

HomelyInspector is a home inspection management platform operated by UP2U LLC. We provide licensed Texas home inspectors with tools to manage inspections, deliver inspection reports, and collect electronic signatures on inspection agreements. These Terms govern your use of the HomelyInspector platform at homelyinspector.com.

2. SMS Messaging Program

HomelyInspector sends automated SMS messages to home inspection clients on behalf of licensed home inspectors. Messages include:

• Home inspection agreement links requesting electronic signature
• Completed inspection report delivery notifications
• Appointment reminders and inspection-related updates

Message frequency: Typically 2–5 messages per inspection. Message frequency may vary based on inspection status and inspector settings.

Message and data rates may apply. Check with your mobile carrier for details on your plan's messaging rates.

3. Consent to Receive Messages

By providing your phone number and signing the Home Inspection Consulting Agreement, you consent to receive SMS messages from HomelyInspector on behalf of your home inspector related to your inspection. Consent is not a condition of any purchase or service.

4. How to Opt Out

You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation message. No further messages will be sent unless you re-enroll.

Note: Opting out of SMS does not affect delivery of your inspection report via email.

6. Platform Use

HomelyInspector is licensed to home inspection companies operating under a valid Texas Real Estate Commission (TREC) inspector license. Inspectors are responsible for ensuring their use of the platform complies with applicable TREC regulations and standards of practice (§§ 535.227–535.233).

Inspection reports generated through HomelyInspector are intended solely for the use of the parties involved in the inspection transaction. Redistribution of reports to unauthorized parties is prohibited.

7. Report Retention

As a convenience, we currently intend to retain completed inspection reports and their PDF files for approximately four (4) years from delivery, and web-based (online) reports for one (1) year. This storage is provided on an "as-is" basis and is not a guarantee. We do not warrant that any report or data will be retained, available, or recoverable for any specific period, and we may change, suspend, or discontinue storage at any time, with or without notice. Inspectors are responsible for downloading and keeping their own copies of their reports and records. UP2U LLC will not be liable for any loss of, or inability to access, reports or data.

8. Disclaimer

HomelyInspector provides software tools only and is not a licensed home inspection company. All inspection services are performed by independently licensed inspectors. UP2U LLC makes no warranties regarding the accuracy or completeness of inspection reports generated through the platform.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. The date at the top of this page indicates when these Terms were last updated.
